Australian laws pertaining to the importation and sale of electronic cigarettes containing nicotine
Australian laws state that in order to import or sell nicotine and related products such as nicotine delivery systems like patches, pills, gums, sprays or electronic cigarettes, these products products must first be approved by the Therapeutic Goods Administration (TGA), however, the problem is that electronic cigarettes have not been assessed by the TGA and therefore no determination has been made in regard to their effectiveness as nicotine replacement therapy, nor have they been assessed to determine quality, safety or long term affects, therefore it is currently illegal to import or sell electronic cigarettes that contain nicotine.
Also, according to the Australian government, electronic cigarettes and their ability to help smokers kick the habit have not been proven at this time therefore companies can not promote e-cigs as a "quit smoking devise", so at this time companies are simply able to refer to them as "smoking alternatives" or "safer smoking devices".
Most country, state and territorial governments including the Australian government have classified nicotine as a dangerous poison making the sale of nicotine without approval a legal offence, most jurisdictions also regulate the production, packaging, labeling and storing of nicotine and nicotine delivery systems including electronic nicotine delivery systems (ENDS) otherwise referred to as electronic cigarettes.
